each of the Transfer Lots for the duration of this warranty period. Reasonable maintenance shall <br /> include repair of sloughing or slope failures. Rinker shall not be responsible for ordinary <br /> vegetation management and/or landscaping. Rinker shall expressly warrant the surface and <br /> subsurface stability of any slope repairs for an additional five(5) years. <br /> (j) Utilities. Pursuant to earlier agreement of the parties,prior to the <br /> execution of this Agreement, for the purpose of serving each of the Transfer Lots, Rinker agreed <br /> to and has properly extended public water supply utilities, at its own expense, through the <br /> Sievers-Duecy Boulevard right of way and provided sewer service at the time frontage <br /> improvements were provided The City has reviewed, inspected, approved and accepted the <br /> utilities provided pursuant to this Section. Rinker has coordinated with the City's Parks and <br /> Engineering Departments as to location of stubs for sewer,water and storm drainage service to <br /> each of the Transfer Lots. <br /> (k) Frontage Improvements. Rinker shall provide curbs, gutters and <br /> sidewalk improvements to City standards for each Transfer Lot on the southerly side of Sievers- <br /> Ducey Blvd. from Glenwood Ave. to Hardeson Road that are consistent with the frontage <br /> improvements required for the re-development of the Rinker Property under Part Two of this <br /> Agreement. Rinker shall not be required to install frontage improvements on the Transfer Lots <br /> until: (a) all necessary utilities have been extended to the Rinker Property; and(b)the frontage <br /> improvements can be installed simultaneously with frontage improvements required on the <br /> remainder of the Rinker Property; provided,however, in no event shall this occur later than <br /> October 31, 2005. Rinker shall develop a timeline for construction of the frontage <br /> improvements,which plan shall be reviewed and approved by the City's Planning,Public Works, <br /> and Parks Departments. <br /> 2004 Revised Development Agreement <br /> 15 <br /> 8/23/2005 <br />
