• <br /> Development Property to its highest and best use under the City's adopted Comprehensive Plan <br /> policies, Zoning Code regulations, and the terms of this Agreement; <br /> B. Rinker, FSA and the City entered into a Development Agreement dated March 28, <br /> 2000. The parties desire by this Agreement to make amendments and to restate their agreement, <br /> as amended, in a single document; <br /> C. This Agreement sets forth mitigation measures and development standards <br /> through which Rinker and FSA intend to develop the Development Property in an innovative <br /> manner which will be beneficial to the community. The intent is to provide for a high quality <br /> development which will benefit the City more than would a development strictly in accordance <br /> with the underlying M-1 standards. The public will be benefited by the establishment of <br /> development standards together with the implementation of mitigation measures through the <br /> non-project rezone/planned development overlay process; <br /> D. This Agreement is entered into pursuant to RCW 36.70B.170, .180, and .190. The <br /> intent of the parties is to describe in this Agreement the development standards and other <br /> provisions that shall apply to, govern and vest the development, use, and mitigation of the <br /> development of the Development Property. This Agreement shall be construed in a manner that <br /> is consistent with applicable development regulations adopted by the City, except as modified <br /> herein; <br /> E. This Agreement consists of three Parts. Part One relates to the conveyance of a <br /> portion of the Rinker Property from Rinker to the City for recreation and/or athletic fields, and <br /> any accessory or complementary use thereto including,but not limited to, open space,parking, <br /> 2004 Revised Development Agreement <br /> 2 <br /> 8/23/2005 <br />
