5 <br /> 5. OPTION TO EXTEND: Lessee is hereby given the option to extend the term • <br /> of this Lease in accordance with all of the provisions contained in this Lease except rent, <br /> for two Three (3) year terms ("Option Term One" and "Option Term Two"), by giving <br /> written notice of exercise of the option ("Option Notice") to Lessor six (6) months or <br /> more prior to expiration of each term. Failure to provide the required Option Notice for <br /> Option Term One shall result in the termination of this Lease upon the expiration date of <br /> this initial term or in the case of failure to provide the Option Notice for Option Term <br /> Two, then this Lease shall terminate at the end of Option Term One. All options are <br /> subject to the terms of this lease. <br /> 6. RENT. Lessee leases said Premises for said term and agrees to pay for the <br /> first 3 years of the lease term, a monthly rental in the amount of$3,333.33 in advance on <br /> or before the first business day of each month during the term of the Lease. <br /> Thereafter, the base rent shall be increased by using a percentage equal to the annual <br /> percentage increase in the Consumer Price Index for All Urban Consumers in the Seattle- <br /> Everett Area. The indexes shall be those published by the U.S. Government for the <br /> nearest period preceding the anniversary date. The base rent will not be increased by <br /> more than eight percent (8%) nor less than three (3%) per year. All rental payments shall <br /> be made to: <br /> Treasurer <br /> City of Everett <br /> 2930 Wetmore • <br /> Everett,WA 98201 <br /> or such other place as the Lessor may from time to time designate in writing. If any rent <br /> is, at any time, five (5) or more days past due, Lessee will be charged a late charge equal <br /> to ten (10) percent of the past due rental amount. All rent payments must be made <br /> without deduction or offset. <br /> 7. USE. The Lessee will use and occupy said Premises for general office use. <br /> Lessee agrees that in the operation of the business to be conducted on said Premises and <br /> in any occupancy thereof Lessee shall comply with the laws, rules and regulations of the <br /> governments of the United States, State of Washington, Snohomish County and City of <br /> Everett. Lessee agrees to maintain the Premises in good condition and repair throughout <br /> the term of the Lease. Lessee agrees not to use any machinery or equipment in the <br /> Premises which might be injurious to the Premises or building or which might cause <br /> noise or vibration which would be objectionable to other tenants. Upon termination of <br /> the Lease, Lessee shall quit and surrender the Premises in as good a state and condition as <br /> reasonable use and wear and tear thereof permits. Damage by the elements or other <br /> actions not caused by Lessee or its employees, agents, customers or invitees excepted. <br /> 8. ALTERATIONS AND FIXTURES. Lessee agrees to accept the Premises <br /> as-is after Lessor's building improvement have been substantially completed, after a <br /> certificate of occupancy shall have been obtained by the Lessor, and at such time as the <br /> Premises shall be suitable for immediate commencement of Lessee's subsequent tenant <br /> improvements. After prior written consent of Lessor, Lessee may make alterations, <br /> additions and improvements in said Premises, at Lessee's sole cost and expense. In the <br /> performance of such work, Lessee agrees to comply with all laws, ordinances, rules, and <br /> • <br /> regulations of any proper public authority, and to save Lessor harmless from damage, <br /> 32 <br />
