7 <br /> • 3. Other Information <br /> The County may request any other information that it deems necessary to <br /> monitor compliance with requirements set forth in this HOME Agreement. Such <br /> information shall be provided promptly by the Agency. <br /> 4. Inspections <br /> At any time during the term of this HOME Agreement, during normal business <br /> hours, the County or its designee may inspect all accounting and other records <br /> at the Agency's office and may inspect the physical premises of the rental <br /> properties developed under this HOME agreement. Upon request by the County, <br /> the Agency shall notify occupants of upcoming inspections of their homes or <br /> records in accordance with State law. <br /> 5. Sub-agreements <br /> Pursuant to 24 CFR 92.504(c)(2)(x), the Agency will include the requirements <br /> found at 24 CFR 92.504(c) in each project or program agreement and contract <br /> assisted with funds under this Agreement. <br /> Each agreement the Agency negotiates to expend these HOME funds and to <br /> conduct the HOME activities described here shall include a form similar to <br /> Attachment "A", which shall describe in full the activities to be undertaken, the <br /> specific tasks associated with the project or program, the budget, and the <br /> schedule for completion. A copy of this Description of Activities shall be <br /> submitted to the County Grants Administration office for review and approval <br /> each time a new activity is undertaken. <br /> III. ENFORCEMENT OF THE AGREEMENT <br /> A. Disputes. <br /> Any dispute concerning questions of fact in connection with the obligations covered by <br /> this Agreement and not disposed of by the terms herein shall be referred for <br /> determination to the County's Director of Planning and Development Services or his/her <br /> designee, whose decision in the matter shall be final and binding upon the parties, <br /> provided however, that if an action is brought challenging the decision, the matter shall <br /> be subject to de novo judicial determination. Nothing contained herein shall excuse <br /> either party from otherwise complying with the terms of this Agreement to the extent <br /> reasonably possible pending final resolution of the dispute. <br /> B. Violation of HOME Agreement by the Agency. <br /> In the event of the violation of any of the provisions of this HOME Agreement by the <br /> Agency, the County may give written notice thereof to the Agency by registered or <br /> certified mail addressed to the Agency at the address stated in this Agreement, or to <br /> such other address as may have been designated by the Agency, and if such violation <br /> is not corrected to the satisfaction of the County within thirty (30) days after the date <br /> such notice is mailed (or within such further time as the County, in its sole discretion, <br /> may permit), the County may, without further prior notice, declare in writing a default <br /> under this Agreement effective on the date of such declaration of default, and upon <br /> any such declaration of default the County may either resort to the courts for relief or <br /> submit the matter to arbitration.
