There were 19 bidders submitting bids on this project. The apparent low bid was submitted by Prospect Construction, Inc.,of Auburn,WA, in the amount of$1,407,109.38. RCW 35.22.650 requires bidders to actively solicit quotations from disadvantaged business enterprise (DBE) subcontractors and to submit evidence of compliance with the bid. Prospect Construction,the apparent low bidder, failed to submit any evidence of solicitation of DBEs. Staff therefore recommends Prospect Construction be disqualified and that Council award the contract to the second lowest responsive,responsible bidder,Award Construction, Inc., of Bellingham,WA, in the amount of$1,504,442.01. RECOMMENDATION (Exact action requested of Council): Disqualify the apparent lowest bidder,Prospect Construction, for failure to comply with RCW 35.22.650 and award the contract for the Transmission Line No.2, Phase 8-A Replacement Project to the next lowest, responsive,responsible bidder,Award Construction,in the amount of$1,504,442.01. 7
