J <br /> ,iiiiee <br /> CITY OF EVERETT <br /> VIOLATIONS HEARING EXAMINER <br /> City of Everett,a Washington ) <br /> Municipal Corporation, ) Case No. 04-0739 <br /> ) <br /> Respondent, ) FINDINGS OF FACT, CONCLUSIONS <br /> vs. ) OF LAW AND ORDER OF THE HEARING <br /> EXAMINER <br /> Jesse Parent ) <br /> 2227 Wetmore Avenue ) <br /> Everett, WA 98201 ) <br /> Appellant(s) ) - _ :,7•,.. <br /> This matter having come before the Violations Hearing Examiner on July 15, 2004, and the testimony of <br /> witnesses having been heard and all exhibits admitted into evidence having been considered, the Violations <br /> Hearing Examiner makes the following findings of fact and conclusions of law and order: <br /> Findings of Fact: <br /> 1. Jesse Parent is the owner of record of the property located at 2227 Wetmore Avenue, Everett, <br /> Washington. <br /> 2. On April 16, 2004,April 26, 2004, May 19,2004 and June 21, 2004, overgrown vegetation,piled <br /> discarded cardboard and debris and a junk/hulk vehicle were observed on the property. <br /> 3. Jesse Parent was duly notified via certified mail, 1St class mail and post property of these conditions <br /> on June 22, 2004, was given the opportunity to correct these conditions; and,has had adequate notice <br /> of the opportunity to appear at the hearing to appeal the city's allegations. <br /> 4. Jesse Parent did not appear at the hearing <br /> Conclusions of Law <br /> 1. The conditions as described above constitute violations of Everett Municipal Code 8.20.020 (A) <br /> (E)and (G) and 8.22.030. 18 <br /> 2. The property owner to date has not completely corrected said violations. Jurisdiction for action <br /> against the property owner for EMC 8.22.030 is allowed pursuant to EMC 8.22.040 (B). <br />
