Gentlemen: This office represents the above named applicant. You have been advised by the city attorney, Bruce Jones , of the entry of an order by the Superior Court on the 22nd of October, 1969 , in Cause No. 97687. This order directa the Board to make proper findings with reference to Lots 4 and 5 and further directs the Board to give notice with reference to Lots 6 and 7 and make such other appropriate findings and order as you deem appropriate based on the evidence of your hearing which you have now aet for December 1, 1969. in order to give substance to your proceedings , I file herewith an application for variance on behalf of the above named appllcant as to the entire ownerahip referred to abave. The filing of this application is not in any way to be deemed a waiver by the applicant of any nonconforming use or property rights which he now holds . As to Lots 9 and 5, the applicant seeks an area variance to permit the construction of a new single family dwelling house in accordance with the plans which have heretofore been submitted to your Board.
