Box 564 I <br /> Mukilteo, WA 98275 i <br /> hereinafter referred to as "Applicant." i <br /> For a varianco from Section 8, Front Yards, to allow construc- <br /> tion of a sinqle family structure on each of the followinq <br /> three parcels with a front setback leas than the twenty feet <br /> required by code. This same variance was qranted by the Board <br /> of Adjustment on June 8, 1988; however, buildinq ;�ermits were <br /> not obtained within one year of that date and so the variance <br /> expired. <br /> On the property commonly known as: Parcels 1 and 3 of BI,1� <br /> N8708115004 and Lots 37,38,�9 and 40 of Hewitt Heights Addi- <br /> tion, all on the south side of Anqle Lane. <br /> The Board oY Adjustment, followinq a public heering on said <br /> application held on May 7, 1990, and further havinq reviewed <br /> all Lestinony, mekes the followinq Findings, Conclusione and <br /> �rder: <br /> FIIODIIfGa l�w+ COIICL�4ION9: <br /> Critarion Ao. i• <br /> That the variance is necessary because of exceptional or ex- <br /> traardinary circumstances reqarding the size, shape, <br /> topography, or locetion of the subject property; ur the loca- <br /> tion of a pre-existinq improvement on the subject property thnt <br /> conformed to the zoning code in eftect when the improvement wes <br /> construct�d. <br /> i <br /> a. p�pq� The subject property c�nsists of three separate i <br /> parcels• with extreme topographic chenqes. Each of the <br /> three lots has a lavel area that varies from zero to twen- <br /> ty-nine feet so�!tri of tha edge of Angle Lane right of way. <br /> The remainder of the lots drop off rapidly to the bottom <br /> of a steep ravine. <br /> The Applicant is proposing to utillze the level area on <br /> the front of each lot to provide bearinqs for footinqs, <br /> garaqe slabs, driveways, and provide for off-street park- <br /> inq for two cars. Bocause of the extreme slope of the <br /> lots, it will be necessary to conatruct the homes on pil- <br /> ing foundations. <br /> Anqle Lane has 40 feet of right of way and the 30 foot <br /> street improvement utilizes only the northern portion of <br /> the riqht of ay, so there is l0 feet of unimproved right <br /> of way abutting the subject lots that will provide a set- <br /> back from the street if the variances are granted. <br /> b. Conclusion: There are unusual circumstances applying to <br /> the subject lot because of the topography and the fact <br /> that there is unused riqht of way on Anqle Lane. <br />
