Adjustment, following a public hearinq on ssid <br /> applicntion held on Mey 7, 1990, and further hnving reviewad <br /> all teatimony, mekes the following Findings, Conclusions end <br /> Order: ' <br /> FIIIDINCB 1��D COMCLtil4IOM8: <br /> Criterion No. 1• <br /> That the variance is necessary because of exceptional or ex- � <br /> treordinery circumstances regarding the size, shape, <br /> topoqrnphy, or location of the subject propertyt or the loca- <br /> tion of a pre-existinq �mprovement on tha subiect property thet <br /> conformad to the zoning code in effect when the improvaaent was <br /> constructed. <br /> a. Findina: The subject property consists of tt�ree separete <br /> parcels with extreme topographic chenqes. Eech o! the <br /> three lots hes a level aree thet variee from zero to twen- <br /> ty-nine Peet south of the edqe of Anqle Lane right oi way. <br /> The remninder of the lots drop off rapidly to the bottom <br /> of a steep ravine. <br /> , The Applicant is propoainq to utilize the leve.l area on <br /> the front of each lot to provide bearings for footings, <br /> garage sYaba, driveways, and provide for ofP-street perk- <br /> inq for two cars. Because of the extreme slope o! the <br /> lots, ±t will be necessary to construct the homes on pil- <br /> ing foundations. <br /> Angle Lane has 4o feet of right of way and the 3o foot <br /> street imp �vement utilizes only the northern portion of <br /> the riqht f ay, so there is 10 feet of unimproved right <br /> of way abutting the subject lots that will provide a set- <br /> back from the street if the varfances are granted. <br /> b. Conclusion: There are unusual circumstances applying to <br /> the subject lot because of the topography and the fact <br /> that there is unused right of way on Anqle Lane. i <br /> i I <br /> � <br />
