3 - . <br /> Ordinance No. <br /> An Ordinance relating to Criminal Impersonation, <br /> Amending Section 58 of Ordinance No. 1145-85, as amended by <br /> Section 1 of Ordinance No. 1972-93 (EMC 10.14.010) ' <br /> WHEREAS the 2004 State Legislature amended the crime of Criminal Impersonation to <br /> increase the penalty for Criminal Impersonation in the First Degree from a gross <br /> misdemeanor to a Class C felony, and to increase the penalty for Criminal Impersonation <br /> in the Second Degree from a misdemeanor to a gross misdemeanor; and <br /> WHEREAS the 2004 State Legislature also amended the crime of Criminal <br /> Impersonation in the Second Degree to cover impersonating a veteran or active member <br /> of the armed forces; and <br /> WHEREAS the State law amendments became effective July 1, 2004; and <br /> WHEREAS the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 58 of Ordinance No. 1145-85, as amended by Section 1 of Ordinance <br /> No. 1972-93 (EMC 10.14.010),which reads as follows: <br /> Criminal Impersonation. <br /> A. A person is guilty of criminal impersonation in the first degree if the person: <br /> 1. Assumes a false identity and does an act in his or her assumed <br /> character with intent to defraud another or for any other unlawful <br /> purpose; or <br /> 2. Pretends to be a representative of some person or organization or a <br /> public servant and does an act in his or her pretended capacity <br /> with intent to defraud another or for any other unlawful purpose. <br /> 3. Criminal impersonation in the first degree is a gross misdemeanor. <br /> B. A person is guilty of criminal impersonation inthe second degree if the person: <br /> 1. Claims to be a law enforcement officer or creates an impression <br /> that he or she is a law enforcement officer, and <br /> 2_ Under circumstances*t 1pt amounting to criminal impersonation in <br /> the first degree,does an act with intent to convey the impression <br /> that he or she is acting in an official capacity and a reasonable <br /> person would believe the person is a law enforcement officer. <br /> 3. Criminal impersonation in the second degree is a misdemeanor. <br /> 10 <br />
