Mootz a varianee of the right-of-way setback <br /> �acing ,'ulton Avenue and providod 120 days for the City to provlde the <br /> elevations. The Publio Works Department field check ahows the garage <br /> to be essentially complete (rather thn., uaiting for our elevation determination). <br /> The survey shoWe that the garagu Wan ounstructed at 1 foot from publlc <br /> right-of-way rathec• thar. 10 feet as uas granted Dy the Board. Due to <br /> Lhc existing narroW right-of-way width and Lho need to use all of the <br /> available publle prope^ty on Fulton, the Publie Works Departmont expacts <br /> a severe grade se�aratior, causing acoess damage to the garage beaause <br /> there !s only one foot setback on prlvate pruperty to mske the tranaition <br /> to the garage elevation whlch was construeted more than one foot above <br /> the elevation of the new sldewalk. <br /> When the street and sideWalks �buttinF this prooertv are imnrove�f the <br /> vchlcle use of the Raraac will bc effectivelv eliminated_ <br /> The garage at 1613 �laker is constructed in violation of the setba�k <br /> provision and the est;�blished grade provision of the variance and the <br /> City uill not expend public funds to provide or correct access to tho <br /> property. Damages resulting from lo�s nf accesn are the renponsibility <br /> of the property ouner (Lots 7 and 6, Dlk 331, Plat of F.verett Dlv. "X"). <br />
