Guadalupe, 7215 - 230th Place N.W. , StanWood, Waehington, 98292, (hereinaiter referred to ae "Guadalupe") requested certification by the City of L�erett for the reeidence at 1717-1/2 Balcer Avenue, fi�erett, Waehington, to be claseified as a non-conforming dvelling. The City of Everett denied the certification and Guadalupe filed an appeal. A hearing on the appeal wae held before the Hearing fsaminer of the City of �erett on May 31, 1990, and on July 19, 1990. A decislon wae made by the Hearing Ezaminer on Auguet 3, 1990. A motion for seconaideration was filed by Guadalupe's attorney, Franklin C. Butler, on Auguet 14, 1990. Because of a malfunctioning tape recording syetem, no tape recording was made of the July 19, 1990, proceeding. As a reeult, the record rrae ineufficient and the hearing had to be re-held.
