Conditions of approval were contained in a written decision from <br /> the City: one oi the conditions of approval was that the ADU would expire once the applicant <br /> ceased to own the properly. Also included in the approval was the condition that a building <br /> permit be obtained (or the work to be done for the new ADU. <br /> No building permits were ever obtained for the upstairs conversion to living space. The zoning <br /> code has subsequently changed, and �ow requires a r�inimum lot size of 5,000 square feet for <br /> an ADU to be approved on site. The subject lot is only 4,800 square (eet in area. As of 1998 <br /> lhe applicant for the original ADU (RPII98-011) no longer owned the subject residence. <br /> Since the applicant of the original ADU application no longer owns the subject residence the <br /> ADU approval is expired. Under the current zoning code there is insufficient lot size to apply for <br /> and approve ar,ADU. Variances can not be sought for density. In order to comply with current <br /> cede requirements lhe upstairs will need lo be internally connected to the downstairs, a�^d one �� <br /> kitchen/cooking taciliry removed. In addition all improvements which were made to the upstairs , <br /> without lhe benefit oi permits will noed to be reviewed and approved by the City. <br /> � <br /> � <br />
