5 INTERLOCAL AGREEMENT BETWEEN GRANITE FALLS SCHOOL DISTRICT#332 AND THE CITY OF EVERETT FOR WATER CONSERVATION AUDITS This Agreement is by and between the City of Everett, a first class city in the State of Washington, and Granite Falls School District #332, of Edmonds, Washington and is effective as of , 2004. 1. Parties The parties to this Agreement are the City OF EVERETT, a Washington municipal corporation (hereafter "City") and GRANITE FALLS SCHOOL DISTRICT #332, a political subdivision of the State of Washington (hereafter "District"), and are collectively referred to as "the Parties." The parties are located in and exist under the laws of the State of Washington. 2. PURPOSE AND RECITALS 2.1 Authority. This interlocal Agreement (hereafter "Agreement") is entered into pursuant to chapter 39.34 RCW (Interlocal Cooperation Act), chapter 36.75 RCW, and RCW 35.77.020 - .040. 2.2 Background. Under the regional water conservation program, the City and its wholesale water customers provide funding to school districts for irrigation system improvements. Such payments are authorized under RCW Chap. 35.92 and RCW Chap. 54.16. 2.3 Purpose. The purpose of this Agreement is to establish a mechanism for the District to request a water conservation audit, for the District to request reimbursement for the audit and water conservation measures identified by such audit, and for the City to reimburse the District. 3. DURATION This Agreement shall become effective upon execution by all parties and shall remain in effect for one year,unless extended by written amendment signed by both parties. 4. PROGRAM 2.4 To enroll in the program, the District requests an irrigation system audit in writing from the City. The purpose of the audit will be to identify improvements and quantify the water savings from these improvements. I4
