Jerry Frisch who reside at 111 Barbara =
Lane, Everett, Washingt.on. I am informed that for the last '^
«.
four months you have been in the process of grading property _
owned by you at 109 Barbara Lane, Everett, Washington, and ,a- x
conatructing a house thereon. This has caused an encroachment .: ,„
problem which muat be immediately remedied. '`
i
Several years ago your Fredecessor, Lee Hayes, constructed a
rockery on the front 144 feet of the property. The rockery m ,.
encroached onto Mr. Frisch 's property by a width of between g '^
four inches to sixteen incnes. Moreover, it resulted in some , m
sloughing of Mr. Frisch's groperty and loss of lateral support.
Mr. Hayes cor.tacted me and admitted that his contractor had z n
caused the >>roblem. Although remedies were discussed, he -' m
apparently sold the property to you before implementing tfe p
same.

x
D
Your recen: activities on the property have seriously increased =
the encroachment so that it now extends up to 36 inches into =
Mr. FriscF,' s property. Moreover, your work has increased the ,
danger of sloughing and loss of lateral support. _
0
-i
To temporarily mitigate the problem Mr. Frisrh has cut a "step" r,
into the embankment and has stablized the same with old tires. "'
This remedy, of course, is unsightly and will only serve as a
temporary measuze to avoid further sloughing until you shore up
the bank in . proper manner. I have contacted the Everett
Build?.ng Department for the purpose of alerting them to the
problems which exist. As you know, they have jurisdictiot over
rockeries and retaining walls of this size. I have also inves-
tigated the auestion of whether you are a bonded contractor,
and W11I D2 financially responsible for damage caused to the
 I M [
JUI ,. ,,
CiTY OF EVERETT
Inspction Dept.
