We ch�ck�d through the reai es— <br /> tate campany and made tei �phone calls and prrsonal checKs with th• <br /> appropriate city offic�s to asc�rtain if any bufldfng plans had <br /> b��n submitted for that prop�rty, otherwisa known as Lots 28 and <br /> 29 of Block 2 or Rucker Park Addition . W were advis�d by all <br /> that no plans had b4en submitted and that a buflding permlt had <br /> not be�n issu�d. N�vertheless, we knew that it would happen <br /> ultimately and expectrd, erroneously as it turned out , that any <br /> r.�onstruction would ba in accord with the g¢neral nature of the <br /> �ieighborhood. Further , as this is a view sensitf �e area, we <br /> exoected that the builder would be considerate of his ncighbor's <br /> existing � iaw. <br /> As notad in the attached hfstory of the. construction , it has not <br /> turned out thia way. We feal that the City Zoning Code has been <br /> � iolated both as to intent, and spaci4ically. Wl� ile it is <br /> realized that a bullder ha• certain leeways, when a presentation <br /> �oith specific drawinga is made to a city body and the actual <br /> tocation of the bullding �aries greatly from that presentatlon , we <br /> feel that a first � iolation has occurred. Also, when a building <br /> plan is appro�ed for a view sensiti �e area, it should be subJect <br /> to close scrutiny and latar follaw—up to insure fhat it does no : <br /> unduly affect the neiyhbors existing � iews. Further , that the <br /> style of the building should fit into, the general architecture of <br /> the neighborhood. LastlY, the zoning code should be adhered to <br /> in a specific manner without allowing manipulation through one <br /> means or anether . Examination o4 the phoiographs and drawings in <br /> thr accompanying hlstory will not create a fiattering �mpression <br /> 04 the execution of the zoning code . <br />
