We ch�cked throuqh th• real •s- <br /> tat• canpany and made t�i�phone ca11s and p�rsanal checks with the <br /> appropriat� city offices to asc�rtain ! f any buildfng plans had <br /> b��n submitted for that prap�rty, othrrwise knaun as Lots 28 and <br /> 29 of Block 2 of Rucker Park Addition. We w�r• aduised by all <br /> that 'no plans had b�en submitt�d and that a building permit had <br /> not b��n issued. N��erth�la:s, we kneu� thxt it would happen <br /> ultimat�ly and exp�ctad, erroneously as it turned out, that any <br /> construction wouid be in accord with th• general nature of the <br /> n�ighborhood. Further , as this is a uiew sensiti �e ar•ea, we <br /> �xp�cted that the builder would b� considnrat• of his nei9hbor's <br /> •xisting � lew. <br /> As noted In the attached hi �tory of the construction , it has not <br /> turned out this way. W� feel that the C( ty Zoning Code has b�en <br /> violated both as to intent, and spocifically. Whila it is <br /> rralized that a builder has co� '.aln le�ways, when • pr�s�ntatfon <br /> with specific drawingi is ma�� to a city body and the actual <br /> location of the building �arles greatly from that prasentation, we <br /> 4�e1 that a first v ( alatfon has occurred. Also, when a buiiding <br /> plan fs appraved for a � iew sensftive arta, ft �houid be subJect <br /> to close scruti�y and later follow-up to insure that it doas not <br /> unduly affect the npfghbors existing � fews. Further , that the <br /> style of the buliding ahould fit into, the general architecture of <br /> tne n� ighborhood. Laatly, the zoning code should be adhered to <br /> In a specific manner without altowing manipulation throuqh one <br /> m�ans or anothar . Examination of the photographs and drawings in <br /> the accompanying history will not create a fiattering impresslon <br /> of the execution of the zonfng code . <br />
