There is a Type Ns and Tpe Np stream and a
Category III weQand on de site.
Applicant:
I,ocation:
7,oning:
David & Judy King
4717 E3elvedere Avenue
verctt, WA 98203
Fast of Harbor Lane and north of Belvedere
R-S, Suburhan Resideiitial
Legal Descriplion: (At 36 of the Plat of' Dadington Replat of Lot X
General Plan: 1.1 - Single Pamily Detached, 3-5 dwellings per gross acre
Cunluct Pcrson: Sleve lnKalshe Phonc: (425) 257-8731
Seciion S.II of the Critic:al Arcas Ordinance allows development of a site withi a critical area's
buffer if the applicant demonstrates all of the (ollowing:
I
2.
3.
Therc ls na other ressonable use or feasible elternativr to the proposed development
witl less impact on the environmentally sensitive area.
Finding: 7'he site is in the R-S zone, which allows a single family residence on a minimum
lot area of 9,W0 square feet. 'I'he lot will be acecssed from Belvedere. A critical area study
by Wr.tland Resources dated Decembcr 8, 2006 (Revisinn 1) shows that there is a Category
I11 wetland at the base of the slope where a Type Ns stream and a Type Np sveam (Phillips
Geek) mcrge ncar the middle of the cast lot line. The Critical Area Ordinance requires that
the buffers af the streams anJ the wetland extend 25 feet beyond the point of where the slope
bccomes less than 259b. The majority uf the site has slopes over 25`%. Thus, the buffers
from the weUand and twu streams encumber the cntire site.
Conclusiun: 7'hc siie can not he devclope.d with any residence widout a rcdaction of the
huffcrs.
Thc proposed development docs not pcse n threat to the public health, reey and
wclfarc on or ofl' of the subject lot.
Finding: i he single family residcncc is a ermitted use in this zonc and will be required to
mcct all building codes and public works standards.
Conclusion: 'I'he proposed development should not pose a thrcat to public health, safety, and
wclfarc on or off thc sub;ect lot.
Any altcrutions pennittcd to the requirements of (the Zaning Code) s6a11 be t6e
minimum necessary to allow for reasonable use of t6e property.
i'+ 2930 Wetmore, Suite R-A, l:verett, WA 9R201-4044 ' (425) 257-8731, faz (425) 257-8742
