The City hau recommended denial of the allowance for the Appellar.ts <br />to seek a variance because of: <br />1. All lots must meet zoning code requirements per Section 4.d.3. <br />2. The existing zoning for the site R-1 which requires each lot <br />to have a minimum area of 7,000 square feet. The proposal does <br />not meet this requirement. <br />3. Section S.c.2. allowe existing structures to be non-conforming <br />as long as all lot requirements are met. <br />CONCLUSIONS <br />1. The appeal is for an appeal of the Everett Planninq Department'a <br />administrative decision prohibiting the Appellants from seeking a <br />varianc4 for the purpose of allowing substandard lots in a two ' <br />lot short plats on property-located at 7901 Beverly Boulevard, <br />Everett, Washington. - <br />2. The residences that exi�t on the subject property are nun-conforming <br />in nature. With a proposed short plat there will be no increase - <br />in density, lot coverage, or any other factor that will impact the <br />property or other properties•_ in the area. <br />3. Other properties in the area are substandard fur lot size. If a _ <br />variance were granted the lots created would not be in conflict <br />with the size of other lots in the vicinity. -- <br />4. Section 6.a.1. allows Appellants to make an application for vari- <br />ances from the lot requirements as set forth in Section S.c.14. <br />However, it is not an all inclusive ordinance and the Appellants <br />are not pnohibited from seeking other variances. <br />5. Ordinance llla-85 Section 5.c.2. requires that division of land -. <br />with existing structures must comply with all zoning requirements <br />including setbacks, parkinq requirements, and height standards. <br />The section does allow structures to remain non-conforming and <br />does allow the subdivision of land as long as the division does <br />not make structures more non-conforming. The proposed subdivision <br />of the Appellants will not make the subject property or the two <br />new lots more non-conforming. <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions, the testimony <br />and evidence submitted at the public hearing, and upon th? impressions <br />
