MITIGATION AGREEMENT <br />THIS AGREEMENT is rnade and entered into this $th day of <br />Februarv, i gq3 , , and between EVERETT SCHOOL DIS', FIICT NO. 2 <br />("District") and Doryan Construction & Development, Inc., and its successors or assigns. <br />E ITALS <br />A. Doryan Construction & Development, Inc. has applied tor a building permit <br />for construction of 6 single family condominium family dwelling units known as Beverly <br />Lake Condominiums (the "ProjecY') the City of Everett Filing No. SEPA # 19-92, located <br />at 7405 Beverly Lane, Everett, Washington. <br />B. The State Environmental Policy Act ("SEPA") provides pracesses and procedures <br />whereby major actions by state and local agencies, inc;uding, but not limited to, the <br />approval of building permit�, may be reviewed to determine the nature and exten; of <br />their impact on the environment. Impacts on public services, including schools, are <br />environmental impacts for purposes of SEPA. SEPA requires the mitigation of adverse <br />environmental impacts. <br />C. The Project will be located in an area where school children residing therein will <br />be served by the District. <br />D. The District has identified the impacts on the District that will be a direct result of <br />the constructior, of the Project. <br />E. The identiiied impacts include the projected addition of 2.76i' students to the <br />District af which .588 are unhoused. <br />F. The District presently has capacity at the elementary and high schools that will <br />serve this project. However, the middle school is at capacity and us a result, the District <br />will have to provide space in portable classrooms and other school tacilities in order to <br />house and otherwise accommodate these students. <br />G. Developer and the District have reviewed the mitigation measures reasonably <br />necessary to mitigata the impacts directly resulting from the Project and have concluded <br />that the provisions set forth below in this Agreement constitute complete and appropriate <br />provisions for full mitigation by Developer of the identified impacts trom the Project on <br />the District. <br />H. Neither the impacts identified nor tl� i mitigation meusures oifered herein affect, <br />reduce or enlarge any other obligation Do��an Construction & Deve�opment, Inc, or the <br />Project has to comply with required land use approvals. <br />
