Thus, without ascertainable standards to allow <br /> 7 the property owner to know when his or her activities are more <br /> 8 than diminimis and by indicating that each case is factually <br /> 9 different, the Board has erroneously made a conclusion that the <br /> 10 plaintiffs' activities constitute a violation of the Zoning Code <br /> 11 which determination, o.n that basis, is arbitrary and capricious, <br /> ��' ' and contrary to law. <br /> 13 9.
