WILLOUGIIBY
City of Everett
Board of Adjustment
City Hall
Everett, WA 98201
Re: Request for Reconsideration of the Appeal
of Robert A. Larson from Findings of
Building Inspector dated April 12, 1977
Dear Member of the Board:
Please be advised that the undersigned represent Mr. and Mrs.
Dale Sabine of 115 Bridgeway, Everett, washington, who operate
Thrifty Towing. By this letter we are requestiny that yoi,
thc-Board, reconsider your oral decision on the above referenced
appeal, at a special meeting to be called, prior to entering
your final written Findir.gs and Decision, for several reasons .
First, the Sabines are a little confused as to the full impact
and effect of your decision. It appears that your decision
may have the effect of prohibiting ritizens from driving their
commercial vehicles to their places of residence and from parking
these vehicles on the city streets . In other words, Sabines
could not even 3rive their tow trucks to and from work as other
persons in the City of verett often ao.
Secor.3, we believe that the Sabines were not afforded proper
and sufficient notice of the proceedings on appeal before the
Doard and, thus, did not have an adequate opportunity to prepare
and present their case. While the appellant, Robert Larson,
probably had a duty to provide adequate notice to the Sabines,
neither he nor his attorney directed any notice to them.
The only notice which the Sabines received was from the Assistsnt
City Attorney, who sent a letter dated June 2, 1977, as a courtesy
to Sabines, a copy of which is attached hereto. However, the letter
' from Mr. Cattle suggests that the Sabines ' attendance is not
necessary, yet substantial rights of the Sabines were to be
affected.
