( ( ' . <br /> (a) The proposed rezone is consistent with the Everett <br /> Comprehensive Plan. <br /> (b) The proposed rezone bears a substantial relation to public health, <br /> safety, or welfare; and promotes the best long term interests of the <br /> Everett Community. <br /> (c) The terms of the Resolution of In!ent agreed to by the Applicant <br /> and the Ciry are sufficient to mitigate adverse impacts upon <br /> existing or anticipated land uses in the immediate vicinity of the <br /> subject property. <br /> 6. The Comprehensive Plan of the City of Everett designates the subject <br /> property as 4.4, Mixed Use Commercial - Multiple Family. The B-2, <br /> Community Business designation is compatible with the Comprehensive <br /> Plan. (exhibit 1) <br /> 7. The subject property was part of the 1990 Comprehensive Plan <br /> Amendment and Intent to Rezone that was approved by the City of <br /> Everett. The properties included properties west of McDougal Avenue <br /> beriveen 18�" and 19'� Streets. The City of Everett Pianning Commission <br /> and Everett City Council determined that a business rezone may have a <br /> detrimental impact on residential areas to the east unless limitations <br /> were placed on the preperties that are the subject of the rezone. The <br /> restrictions of the 1990 rezone included the location of off-street parking <br /> on the subject property; no access permitted from McDougal Avenue; <br /> minimum rezone standards for development; and requirements for <br /> landscaping, lighting and signage. The proposed rezone has been <br /> reviewed by the City of Everett Planning Department and determined that <br /> the changes reyuested would not be contrary to the 1990 amendments <br /> and would be consistent with thF conditions placed thereon. (exhibit 1) <br /> 8. With the exception of the parking area, which is zoned R-2, the entire <br /> Bartell site is zoned B-2. The zoning change will create consistency of <br /> �he site. (exhi6if 1) <br /> 9. It is the intent of the Applicant to develop the subject property with a drug <br /> store. The historical use of the entire Bartell site has been commercial, <br /> with the True-Value Hardware Store and Castle Drug Store being located <br /> thereon. Parking for these commercial uses was across the alley with <br /> frontage on McDougal Avenue. The Castle Drug Store's property owners <br /> received a variance in 1966 for commercial parking on the R-2 zoned <br /> portion of the site.
