BOARD OF AGJUSTNENT <br /> rINDINGS, CONCLUSIONS AND ORDER <br /> VARIANCE NO. 15-90 <br /> Based upon the written request for a variance from the City's <br /> zoning code by: <br /> Applicant: Oliver A. williams <br /> 1915 Broadway <br /> Everett, WA 98201 <br /> hereinafter referred to as "Applicant, ° for a var.iance f.'rom i <br /> Section 18, Parking, to allow the continuation of commercial <br /> and residential uses that require a total of seven off-street <br /> parking spaces and are providing only four in tandem off the <br /> alley. <br /> on the property commonly known as: 1915 Broadway <br /> The Board of Adjustment, following a puUlic hearing on said I <br /> application held on July 9, 1490, and further having reviewed <br /> all testimony, makes the following Findings, Conclusions and '� <br /> order: <br /> FZNDINGS AND CONCLUSIONS: <br /> Criterion No. 1: <br /> That the variance is necessary because of exceptional or ex- <br /> traordinary circumstances regarding the size, shape, <br /> topography, or location of the subject property; or the loca- <br /> tion of a pre-existing improvement on the subject property that <br /> conformed to the zoning code in effect when the improvement was <br /> constructed, <br /> a. Findings: The property in question is a 25 foot wide by <br /> 120 foot long lot in z B-2 zone. There is an existing 25' <br /> x 40' (1000 square foot) conunercial building on the front <br /> of the lot that was constructed in 1946. At that time <br /> there was no code iequirement for off-street parking; how- <br /> ever, there was room on the rear of the lot to informally <br /> park six vehicles. A small residential structure was <br /> added behind the commercial structure in 1987 . There is no <br /> record in file of any consideration being given to the <br /> matter of parking at the time the residential structure <br /> was built, except that four parking spaces are shown on <br /> the site plan submitted for the single family construc- <br /> tion. <br /> The Applicant has the property for sale and a prospective <br /> purchaser wanted confirm� ion that the property met the <br /> zoning code requirement� i•1 regard to off-street parking. <br /> The City was not able to �ertify that the property met <br /> zoning code requirements, since the residential structure <br /> had been constructed without providing the additional two <br /> spaces required by code. At this time, the City cannot <br /> certify that the existing residential structure is a legal <br /> building unless a variance is obtained for parking. <br /> Part of the commercial structure is used as a barber shop <br /> and the remaining approximately two-thirds is retail <br /> sales.
