Grainger Development Group LLC and SEG 23r°, LLC, lt is letter is providing <br /> you wilh sufficient notice to satisfy the public notice requirements set forth ,n the N'ashington <br /> Department of Ecology's Substantial Equivalence lor Tax Exemptions Gu;dance do�ument (R- <br /> TC-98-600) and the Model Toxres Control Act Cleanup Regulation WAC 'i73-340-545(3). <br /> Copies oi lhis notice letter are also being sent to the Washington Depart,ment of Eco;�gy Toxics <br /> Cleanup Program, the City of Everett Puhlic Works, the City of Everett Department of Planning <br /> and Community Developrr�ent, the Cily of Everett Public Services Division and the Snohomish <br /> County Health �istrict. <br /> The releases at the property include concentrations of total petroleum hydrocarbons (TPIi) and <br /> associaled compounds found in soil above the Model Toxics Control Act (MTCA) Method A Soil <br /> Levels as documented in Kane Environmental's Phase I Environmental Site Assessment(ESA) <br /> and Limited Phase II Environment�l Site Assessment report dated December 12, 2002 and ihe <br /> Limited Phase II Investigation repo�t for the Total Rentals property dated December 7, 2002. <br /> One copy oF the Limited Phase II Investigation for the Total Rentais property and the Phase I <br /> �SA and Limited Phase II Investigation and were sent to you via reyular mail on December 3 <br /> and December 17, 2002 respeclivaly. <br /> The expected remedial aclion includes removal of underqround slorage tanks (USTs) and <br /> subsequent removal of TPH-contaminated soil for recycling by thermal desorplion. <br /> Based on the requiremenls established in WAC 173-340-545(3)(b), Conoco/Phillips could be <br /> held liable for the costs of the remediai actions baing conducted. <br /> S.E.
