CITY OF EVERETT - BOARD ��F ADJUSTt�ENT ORDER <br />� �/ � <br />, - i ✓ i � :c'_.�'.�i,�./.(J <br />P7HEREAS, theretofore, there was filed with the City of <br />Everetc Planning Department on (date) April 20, 1976 an application <br />for a variance of Section No. 40.020 of Everett Municipal Code Cha- <br />ter 19 by (applicant) Consolidated Dairy Products Caa an (address) <br />G35 Elliot Avenue West, Seattle, Washington 98119 for (specific <br />variance requested): <br />Permission to reduce the nusber of parking stalls <br />to forty-eight (48) rather than the required <br />one-hundred eighteen (118j <br />on the fol.lowing described property: <br />Block 567, Lots 11 - 22 inclusive Plat of Everett <br />Address: 2531 Sroadwav <br />Zoning: C-1, General Commercial <br />AND: WHEREAS, (date) May 3, 1976 was fixed as the date of hear- <br />ing on said applicatfon and proper notice having been given as re- <br />quired by law, <br />AND: tdHEREAS, a rublic hearing was held on said date and the <br />Board of Adjustment, after reviewing all testimony, made tne findinqs <br />that: <br />1. There ar•. exceptional circumstances or <br />conditions applying to the subject pro- <br />perty that do not apply to other proper- <br />ties in the same vicinity or zone, speci- <br />fically that additional property for par}:- <br />ing is not available directly adjacent <br />to the building. <br />2. That such variance is necessary for the <br />preservation and enjoyment of a substantial <br />nroperty right of the applicant possessed <br />by owners of other properties in the same <br />vicinity or zone. <br />3. That the authorization of such variance will <br />not be materially detrimental to the public <br />welfare or injurious to property in the vi- <br />cinity specifically that the existing park- <br />ing area is black topped and lined and has <br />been used for parking for several years. <br />NOw, THEREFORE, based on the foregoing findinqs: <br />LiE IT ORDERED SY THE CITY OF EVERETT HOARD OF ADJUSTMENT that said <br />application be GRANTED with the following stipulations: <br />Page 1 oi 2 <br />As a condition to the granting of this <br />:-ariance the following stipulations were <br />made: <br />1.
