That there are exceptional circumstances or conditions applying <br />to the subject pro�erty that do not apply to other properties <br />in the same vicinity or zone, specifically that additional <br />prooerty for parking is not available directly adjacent to <br />the building. <br />2. That such variance is necessary for the preservation and'en- <br />joyment of a suUstantial property right of the applicant <br />possessed.by owners of other properties in the :>ame vicinity <br />or zone. • <br />3. That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in <br />the vicinity specifically that the existiny parking area <br />is black topped and lined and has been used for parking for <br />several years. <br />As a condition to the granting of this variance, the following sti- <br />pulations were made: <br />1. That the applicant present a plot plan showing a minimum of <br />sixty-six (66) legal (by City standards) parking stalls. <br />2. That the applicant furnish to the Director of Communitp De- <br />velopment proof of financing from the lender. This yFiould <br />be accomplished within_thirty (�30) days from this date. <br />3. The Variance will go only to Mr. Collin� and will become <br />null and void if Mr. Coll:ins does n�i proceed with the in- <br />tended restaurant. <br />4.
