PROPERTY USE PERMIT 52-88 <br /> EVk�2GREEN FUlIER1�L HOlIB <br /> WHEREAS, there was filed with the City of Everett Planninq <br /> Department on January 19, 1988, an application for a Special <br /> Froperty Use Permit, under Everett Municipal Code (E.M.C. ) <br /> 19.58.010 by John Malletta, 224 W. Spruce, Missoula, Montana 59801 <br /> described as follows: <br /> A permit to allow the constiuction of a 540 sf addition <br /> to an existing funeral home to house a crematorium on an <br /> approximately 96 acre site located west of Broadway and <br /> north of 47th Street; and <br /> WHEREAS, after proper notice was qiven as required by law, <br /> a public hearing was held on March 3 , 1988 before the City of <br /> Everett Land Use Hearing Examiner; and <br /> WHEREAS, after due consideration of the evidence elicited <br /> durinq the public hearing, the Everett Hearing Examiner made <br /> findings of fact and conclusions and rendered a decision on March <br /> 21, 1988 , to deny the Special Property Use Permit; and <br /> WHEREAS, on March �1, 1988 Lorry Hudson of Evergreen <br /> Funeral Home requested that the Hearinq Examiner reconsider his <br /> decision of March 21, 1988; and <br /> WHEREAS, on April 15, 1988 the Hearing Examiner issued an <br /> order denyinq the request for reconsideration from Lorry Hudson; <br /> and <br /> WHEREAS, on April 27, 1988 Thomas D. Adams, Attorney <br /> submitted ar. appeal of the Hearing Examiner's decision on behalf <br /> of Everqreen Funeral Home; and <br /> WHEREAS, on June 8, 1988 a public hearing was held before <br /> City Council to hear the appeal of the Hearinq Examiner's <br /> decision; and <br /> WHEREAS, City Council made additional findings of fact and <br /> conclusions ar.d voted to reverse the Examiner's Conclusion 6, <br /> reverse the Hearing Examiner's decision, and direct approval of <br /> SPU N2-88 subject to the conditions recommended by the Planning <br /> Department; and <br /> WHEREAS, the Special Property Use Permit is granted <br /> subject to the following conditions: <br /> 1. The site must be developed in a manner consistent <br /> with the site plan presented at the public <br /> hearing. <br /> 2.
