'.: ,
. ^ .-
In addition, E.M.C. 19•44.030 states that the applicability of this
section to a particular use shall be determined by the building
official. In makir.g this determination the building official shall
consider the following:
A. The impact of the use on the residential character of the
area from the standpoint of aesthetics, privacy, nuisance,
traffie and the overall integrity of the residential
neighborhood;
B. The need for such home occupation to be located in a residential area
versus a commereially zoned area, it being the intent of the requirement to
preserve the stability of the City's commercial areas;
Concerns expressed by neighbors have been in regacd to the folloaing:
1. Proposed construetion of a large addition to the existing garage would be
out of character with the neighborhood and also block their views which xas
why they purchased their homes.
2. Buainess being conducted in a rasidential zone reduces their property
values.
3, Customer traffie, customer parking on the street and occasional blocking of
drivexays by customer cars.
4. U.P.S. deliveries every day.
5• Storage use and dumping of toxie flammable chemicals.
For the above reasons the City is denying your application for a home ecupation
permit. The purpose of the Home Oecupation Code is to allow a limited number of
residentially oriented businesses to remain in the home. The intent of this code
is to preserve the stability of the City's commereial zonee as xell as to
preaerve the residential character of the City's residential zones. It Would
appear that your business has groWn to the point where it is no longer appropriate
in a residential zone and should be moved to a commercial zone.
In order to not ereate an undue hardship the City will consider a reasonable
proposal from you as to when you can relocate. Please contaet Pearl Maddy at
259-a731 by FeLruary 3 1986 with your proposed schedule or if you xish to
discuss this further, schedule a meeting time xith Bob Landles, Prineipal Planner.
If you dise.gree with the decision you have the right to appeal to the Hearing
Examiner. Such appeal must be in writing and filed with Lhe City's Hearing
Examiner aithin ten (10) days of your receipt of this letter. insti•uctions are
enelosed and if you have any questions piease call Pearl Maddy at 259-8731.
r ,
ncely ; /
i /
/ y
t%1 i ZL-- IL -tG7L 41 l,"sr.,.
nnis L.
