R Nettle hereina:tcr ^� <br /> � referred to as "Oµ•ner;' owns certain property within the City of Everett legally � <br /> � described as follows: <br /> �--� <br /> O <br /> {,n Lots 28 and 29, E3iock 13 , Replat of Pinehurst , Division A , <br /> CL� <br /> WHEREAS, Owner has applied for a permit from the City of Evcrctt whi^;, <br /> under Ordinance 555-78 and subsequent amendments thereto require certain improve- <br /> ments to be made to public rights of way as a condition to issuance of certain City <br /> permits; said Ordinances allow that the City Engineer may accept a covenant consenting <br /> to the formation of a local irnprovement district in lieu of liaving Owner construct <br /> and install the required public improvements. <br /> WHEREAS, Owner's property and the adjacent public rights of way have <br /> been determined to require a covenant consenting to the forrnation of a local improve- <br /> ment district rather than having Owncr make specific improvements. <br /> NOW, TH[RCFORG, in consideration ot issuance o[ applicable City permit(s) <br /> pursuan: to f�dinance No. 555-78 and subsequent amendments thereto and in lieu � <br /> of certain pu�lic right of way improvements Owner consents to thc formation of ' <br /> a Ixal improvement district hereafter formed by the City or its successors or I <br /> other property owners for the public improvement ot: � <br /> u300 Block of Broadway and �4DO block of Lexinqton and allev I <br /> in rear. — ! <br /> t <br /> or a portion thereof including street improvements defined in Ordinance Nos. 555- � <br /> 78 and subsequent amendments *� include: <br /> The installation of all public facilities required to improvc ' <br /> the street to City design standardsincluding gradin�, drainage, ' <br /> pavement, curb/gutter, sidewalk, strect lights, tra(tic signals � <br /> and other necessary appurtenances. Such street improvements � <br /> � .shall not be limited to the half street abutting the property; <br /> for example, where no permanent street i��;Nrovement existed, <br /> the strect improvement shall be extended bcyond thc centerline <br /> a sutficient distance (l0 ft. minimum) to permit safc movement <br /> of traitic. <br /> This Covenant consenting to the formation of a local improvement district <br /> applies (and precludes legal protest) only to the formation of a local improvement <br /> di,trict, pwner executing this document retains its, his/her or their rights under <br /> law to provide input on the proposed public improvements to be accomplished by <br /> such local iinprovement district including n�ture and type ot improvements as we❑ <br /> as the proposed or final benefits and assessmeM therefor. <br /> The City shall deliver a signed release of this Covenant to Owner after completion � <br /> of public improvements as described hereinabove through the tormation of a local <br /> improvement district and after transmittal of the final assessment roll to the County � <br /> . of Snohomish pursuant to law.
