PLANNING DIRECTOR DECISION <br />Review Process 1 #32.97 <br />October 7, 1997 <br />The City of Everett Planning Department grants approval of a request by Custom Craft <br />Homes, Inc to construct a single family residence with a reduced front setback on a lot <br />that is approximately 40% envir:mmentally sensitive at 3XXX Burl PI., Lot 139, as shown <br />on the approved site plan with the following conditions: <br />1. Provide a permanent fence along the top of slope prior to issuance of building <br />permits. Solid board, post and rail, chain link, picket fence or other type of fence <br />that is acceptable to the Planning Department shall be used. An Environmentally <br />Sensitive Area sign must be posted on the fence. The signs are available from the <br />City of Everett permit services counter. <br />2. Provide a recorded Environmentally Sensitive Area Protective Covenant protecting <br />the slope and buffer prior to issuance of building permits. <br />3. Reduck. ,he amount of driveway to 20 feet in width within the front setback. <br />4. Remove yard waste and debris from the slope prior to issuance of building <br />permits. <br />5. No structures will be permitted within 25 feet from the top of slope. <br />The Planning Director approved the modifications based on the following: <br />Section 37.050.E of the zoning code allows the reduction of building setbacks or buffers <br />through Review Process I. The Planning Director, using Review Process I, is authorized <br />to "...approve, disapprove or approve with conditions the use proposed by the applicant' <br />(Subsection 42.100.13). <br />The property is zoned R-1, Single Family Detached Low Density. A single family <br />residence. approximately 1,591 square feel in floor area is proposed to be located on a lot <br />with a slope of over 25%. A stream is located at the base of the slope. Approximately <br />40% of the 8,849 square foot lot has a siope of 25% or more. <br />Section 37.050.B states that nothing in the ESA ordinance is intended to preclude <br />reasonable economic use of property as set forth herein. If the requirement of this <br />ordinance as applied to a specific lot would deny all reasonable economic use of the lot, <br />development will be permitted if the applicant demonstrates all of the following to the <br />satisfaction of the Planning Director: <br />1. There is no other reasonable use or feasible alternative to the proposed <br />development with less impact on the environmentally sensitive area; and <br />2. The proposed development does not pose a threat to the public health, safety and <br />welfare on or off of the subject lot; and <br />3. Any alterations permitted to the requirements of this Ordinance shall be the <br />minimum necessary to allow for reasonable use of the property; and <br />
