Th3 actions brought ageinst Mr. Pintler included the <br />constructlon of r�n illegel bulkhead on his property and the placement of illegal fl�l. In <br />addi!ion, the Cily c:ontended that a berm and additional fill hed been placed o�i the west <br />side ui a Native Growth F'rotection Easemenl. This development of a berm was in violation <br />of the conditfons o( the short plat approval of which the subject property was d�veloped. <br />After exlensive testimony and evidence at the hearings. the City and Mr. Pintler caucused <br />and reached en agreement of the violations. The agreement reached between lhe City <br />and Mr. Pfnller included: <br />The bulkhead will be removed hom lot !f4 of ShoR Plat #1202-31-86 ;n a <br />manner that will cause the least amount af impact to Pigeon Creek #2 and <br />the Native Growlh Protection Easement that fs located on the subJect <br />property. <br />2. All illegal filf will be removed. <br />3. A representative of the City of Everett will visit the site and determine the type <br />of Native Growlh Protection Easement restoration thet will be required. The <br />restoration will Include native species. <br />4. All work will be completed by April 30, 1993. <br />Accordingly, no further ection will be taken by the Hearing Examiner of lhe City of Everetl <br />on the violatfon of Mr. Pintler if all of the above mentioned terms oi the agreement are <br />satisfied. Faflure to adhere to the ebove terms will result in the Hearing Examiner makinq <br />a decision on the request of the City for a Cease and Desist Order requiring the complate <br />restoration oi the Natfue Growth Protection Easement and the removal of aIl illege! fill and <br />construction. <br />
