DECISION: The City of Everett Planning Director hereby gronts approval to modify the . <br /> steep slope areas located at 5717 Cady Road, in order to allow for a retaining wall on site, <br /> with the following conditions: <br /> 1. A building permit is required for any portion of the retaining wall exceeding 48" in <br /> height. <br /> 2. Any portion of the reteining wall supporting vehicle surcharge is required to be <br /> designed by a structural engineer. <br /> 3. A minimum of ten (10)trees planted 10' on center must be provided along the top <br /> of bank, on the level side ot the retaining wall. The trees should be a minimum of <br /> six feet tall at time of planting. Suitable species include Vine Maple and Red Osier <br /> � Dogwood, or other similar trees approved by the planning department. <br /> 4. The steep slope areas must be identified as an Environmentally Sensitive Area <br /> and a covenant, which identifies this area and restricts future alteration or <br /> modification must be recorded for the property. <br /> 5. The applicant must record a covenant that runs with the land which waives claims <br /> against the C(ry, its ofticers, employees and agents, and indemnifies (including <br /> reasonable attorney's fees), defends and saves the City, its oHicers, employees <br /> and agents harmless from any loss or damage to people or property either on or <br /> oH the subject property resulting from any form of soil movement whatsoever <br /> and/or Irom any form ot failure in design and/or constructfon of the improvements <br /> thereon whatsoever. The owners o(the subject propeRy sha�i pravide the City with <br /> the covenant and it shell be signed and acknowledged by all parties with an <br /> interest In the property. The covenant shall also provide notice concerning the <br /> presence of uncontrolled fill and environmentally sensitive features on the <br /> property. The covenant must be presented to the City for review and approval <br /> and, upon approval, recorded by the applicant with the Snohomish County Auditor <br /> prior to issuance of any permits for the site. <br /> 6. Compliance with all other local, state and federal codes is required. <br /> APPEALS: This determination may be appealed to the Land Use Hearing Examiner. <br /> Any such appeal must be filed within 14 days ot the date specified below. Appeal forms <br /> are available trom the Plenning Department and must be submitted along with the <br /> required filfng fee.
