The sign vas orginally installed in
962 via a permit [rom the city. The terms of the permit stte, in part, that thc
owner "agrees to remove th sign upon notice trom the city".
1 havt contacted Crik Lnlc,nd o[ the Skate Ueck and reyuested him to remove thc i
sign. He was not inclined to agree with this request. He indicated he intended to
utili.e the sign to advertisc his building at 2201 California, thc next block to th I
east. As you are auare, the property oµner at 2727 Uroadway, whrre the sign is
lor_.ted, cants the sign removed. .1r. Cngland's position is that the tiign is locatrd I
on public right-of-way, the sign was thrre when the property owner established his I
business so they kneu what they were buying into, and that he further has rights to
Icave the sign therc or sell .hose rights to others.
I have reviewed the situation with Jim Iles, Legal, and he cuncurs that the city has
the rir,ht to require the signs removal. 1 uould recommend that the city give Mr.
England o[ficial notice to remove the sip,n and/or direct him to rrake application to
City Counr_il tor thc iewP of citq rights-ut-uay.
LC:gs
'i
I
M

I '
