It has been suggested that the City order Mr. Frost to cease his automobile,fnotorcpcla sales activity at the above address . Experience with Mr. Frost indicates that he will resist this effort. so prior to pursuing tl�e matter formally, I want to make sure that we will be successful. At this point, the City's position is that Mr. Frost is conducting a legal non-conforming use on his properties at 1107 and 1111 Casi.no Road, that being an auto repair business. However, it is further our position that the sale of used cars and new motorcycles is an illegal expansion of that use. We desire to compel Mr. Frost to cease all sales activity on the property. The following facts andjor evidence are presented in chronological order: Aug�ist 2�, 1959 : Roy Howlett sells Casterly portion of Lot 8 (1111 Casino) to Fay Frost (attachment 1) . In doing so , an illegal lot segregatiun occurred, since the most westerly portion (here referred to as Lot 8A) contains only 9800 square feet which was less than the minimum under the County 2oning Resolution (attachment 2) . I'urthermore, it does not appear that the segregation was ever recorded with the County. August 1 , 1962 Lot &, Block 4, Deverly Home Tracts, Division 1 anne�ced to City as part of South Pinehurst Annexation. September 4 , 1962 Dusiness License issued to Fay Frost by City to operate auto re�air at 1111 Casino. B60 Taxes have been paid continuously since then.
