Your bill relates to an upgrade of the existing four-inch side sewer to a six- <br /> inch line where the old right-of-way line was located prior to the street improvements <br /> constructed under Local Improvement District(L1D)No. 709, and where the new right- <br /> of-way line is now located after the LID improvements. (This right of way was acquired <br /> from the owner of 125 W. Casino Road to provide room for a bus pull out.) As we <br /> understend it, you have invoiced the city for the cost of the extension because you feel the <br /> city should have done this work in the public right of way when the street improvements <br /> were constnicted under LID No. 709. <br /> After researching this issue more thoroughly, we have made the following conclusions: <br /> • At the time of the LID(1981-1984), the existing side sewer connection serving 125 <br /> W. Casino Road consisted of a four-inch line on the private property side, connected <br /> to a six-inch stub between the main and the limit of the public right of way before the <br /> property acquisition for the bus pullout. Our records indicate that the private side of <br /> this sewer connection was capped in November of 1973,because the house served by <br /> the connection had been destroyed by fire. Therefore, 125 W. Casino did not have a <br /> functioning sewer connection at the time of the LiD. <br /> . The city solicited private development plans Gom property owners when the street <br /> improvements were being designed. Plens that were submitted were then reconciled <br /> with the proposed public improvements to assure consistency. We are unaware of any <br /> development plans that were submitted relating to 125 West Casino Road. <br /> • The LID was limited in scope to street and storm drainage improvements, except <br /> where property owners made specific requests to upgrade sewer and water servicea in <br /> the public right of way to accommodate future development, in which case those costs <br /> were assessed against the benefiting properties. A�ain, we are unaware of any such <br /> request being made regarding 125 W.
