Enhance the remaining 12.5 feet of buffer as proposed in the landscape plan dated <br /> September 9, 1997. A two year assurance device worth 10% of the cost of <br /> planting the buffer nnd landscaping will be requircd prior to occupancy. <br /> 2. Provide a permanent fence a minimum of 42" high along the westem boundary of <br /> the buffer. Solid boazd, post and rail, chain link, picket fence or other type of <br /> fence that is acceptable to the Planning Depurtment must be used. The fence must <br /> be marked with an Environmentally Sensitive Area sign. The sign is available <br /> from the Planning Depariment. <br /> 3 . Provide a recorded Environmentally Sensitive Area Protective Covenant <br /> protecting the buffer. <br /> A weUand cxists off-sile to the easL The buffer from the wetland extends 25 feei oeyond <br /> the top of slope. Subsection 37.100.0 of the City of Everett Zoning Code gives lhe <br /> Planning Director the authority to reduce the 25 foot setback from the top of slope only <br /> when there has been substantial legai alteration of the wetland's buffer and the remaining <br /> buffer is enhanced sufticienUy to improve the functional values of the bu}'fer. <br /> The Planning Director approved the reduced buffer bused upon the following: <br /> 1. The buffer wns altcred prior to 1990, most likely during the road construction of <br /> Wcst Casino Road. The buffer consists primarily of Himalayan blackberry. <br /> 2. 7'he enhancement plan will improve thc functional values of the buffer. The <br /> proposal includes removing nonnative plants and revegetating the remaining <br /> hufTer wiUi native vegetation. <br /> The Planning Director's determination may be appealed. Any such appeal must be filed <br /> within fourtecn calendar days of the date specified below.
