In the event Grantor places any improvements on or in the easement or construcu <br /> anything within the easemrnt without first having obtained the written approval of the City <br /> Enginar, the Grantor shall cease all such activity and remove any and all improvemenu <br /> placed thercin without the written agreement of the City Enginar. In the event Grantor fails <br /> to obtain prior approval, Granror hereby authorizes the Ciry to remove any and all <br /> improvements placed or conswcted therein and hoid the City, its officers, employa,� and <br /> aQenu harmless from damage caused W said improvements from removal thereof. Grantor <br /> further agrces W pay the City for any and all costs incurted by the City in removing the <br /> improvements. This right is in addition to any other right the Ciry may have at law or in <br /> equity. <br /> 6. Grantor does rclease, indemnify and promise to defend and save harmless the City, <br /> its officers, employees and agents from and against any and all liabiliry, loss, damaQe, <br /> expense, acdons and claims, including cosu and reasonable attorney's fees incurred by the <br /> City, its officers, employces and agents in defense thercof, azserting or arising dimdy or <br /> indirecdy on account of or out of Grantor's use or acdviry within the above-described <br /> rasement.
