The City would like to facilitate the construction oi new <br /> housing and to reduce the effects oi intlation on the final costs oi housing to the <br /> residmu oi Everett. <br /> y, Developec recognizes and a:imowledges the need for improvement of <br /> Casino Road because ef the facts set forth herein and Exhibit A as incorporated <br /> .herein. Developer shall iuliy comply with the requiremenu for obtaining a building <br /> p^rmit for its proposzd development as set forth in Exhibit A, as well as other Clty <br /> ordihances. � ' <br /> 3, Upon fulfillmmt by Developer oi the requlrements currently set Sorth <br /> in Exhibit A, and compliance with all other applicable•ordinances and regulations, <br /> the Clty wiU issue a building permit,to Developer for construction of its proposed <br /> development in accordance with the plans and speciiications o� file for that project., <br /> and approved by the City of Everett Building Department. <br /> � q, Developer will not be slig(ed out by Ci:y to perform any requlremmt, <br /> which' dots nut apply equally to other developments proposed or to be proposed <br /> along Casino Road which are similarly situated. Failure to comply with the terms of this Agreement on the part of <br /> Developer shall result in immediate suspension of all permits rclated to the <br /> ' construction of the subject development; all other remedies of the City including <br /> � thosc under the Uniform Building Code or other ordinances of the City are <br /> eapressly preserved as additional to any remedies herei�. <br /> 6. Upon eaecution of this Agreement, and compliance with all other <br /> applicable ordinances and regulations, the City will issue grading a�d right of way <br /> usc permiis to Dc��eloper Jor its proposed devclopment in the vicinity of Casino <br /> , f:oad.
