Higa: <br />;Ticor Order No. F-275169; <br />It is my understanding that your company will be acting as <br />escrow agent for closing of a sale of certain property in lveratt, <br />Washington (the •Property), by Dariotis Developments, Inc. <br />(•Dariotis•) to Atlantic Richfield Company ("ARCo•), pursuant to <br />the Real estate Sales instrument Offered By seller (the "bales <br />Agrsamenta), which Bata forth the basic terms of the transaction. <br />The parcel of property to be sold to ARCO cannot legally be <br />conveyed until the City of Everett has given final approval to <br />the binding site plan (already preliminarily approved) that will <br />accomplish the lot line adjustment necessary for closing this <br />transaction. it is my understanding that ARCO will post a bond, <br />establish a set -aside, or make other arrangements with the City <br />of sverstt to obtain final approval of the binding site plan <br />pending construction of all required improvements. At that <br />time/ I will provids you with closing instructions and make <br />arrangements for preparation of all documents necessary to close <br />this transaction. <br />As a condition of granting final approval of the binding <br />site plan and issuing a building permit for the ARCO mini -mart, <br />the City of Everett has requested that both ARCO and Dariotis <br />execute and deposit in escrow utility easements in favor of the <br />City of Everett over certain portions of their respective parcels. <br />I have enclosed with this letter an original Easement executed <br />by Chris Dariotis, President of Dariotis Developments, Inc., on <br />May 8/ 1988.
