FACTS AND CONDITIONS <br />IN SUPPORT OF THE APPROVAL OF A SIGN VARIANCE <br />ARCO AM/PM MINI -MARKET LOCATED AT <br />[doll 41*1d1il%1M1 62361.1r <br />EVERETT, WASHINGTON <br />BCE JOB NO. 2552 <br />The City of Everett Zoning Cnde Section 19.70.060 JURISDICTION- VARIANCES - <br />CONDITIONS authorizes the City to grant variances "in specific cases from the provisions <br />and requirements of this title (Title 19, City of Everett Zoning Code) not otherwise <br />restricted in this section, as will not be contrary to the public interest; but only where <br />owing to special circumstances pertaining to a specific piece of property, the literal <br />enforcement of the provisions or requirements of this title would cause undue or <br />unnecessary hardship." This section of the City of Everett Zoning Code specifies specific <br />finding of facts and conditions which authorize the approval of a variance request. The <br />following are the applicants responses to the four specific criteria set forth in this <br />section of the City of Everett Zoning Code for the approval of a variance request. <br />A. "That there are exceptional or extraordinary circumstances or conditions <br />applying to the subject property or as to the intended use thereof, that do not <br />apply generally to other properties in the same vicinity or zone." <br />2552.21 <br />Aoolicants response: The stated purpose of the B-I (Neighborhood <br />Shopping Zone) "is to provide for and protect certain areas in the City for <br />retail businesses and services serving primarily the residents of the <br />surrounding neighborhood." The B-I Zone permits not only retail commercial <br />uses but also high density single-family residence and low density multi -family <br />residential dwellings. Automobile service stations such as the proposed ARCO <br />AM/PM Mini -Market are a permitted use in the B-I, Neighborhood Shopping <br />Zone. The specific site of the proposed ARCO AM/PM Mini -Market poses both <br />exceptional and extraordinary circumstances and conditions as to the intended <br />use of the property as a mini -market and retail gasoline sales outlet. This <br />Sit& is unipue as a automobile service station location as it is an interior lot. <br />This is extraordinary as generally automobile service stations are Iosated on <br />corner parcels which are bonded by high volume traffic streets on both <br />abutting sides. The unique character, location, and use of this property do <br />not generally apply to other automobile service uses in the vicinity. These <br />conditions and the fact that an automobile service station jf a permitted use in <br />the zone establish both an exceptional and an extraordinary circumstance for <br />this use. This fact, therefore requires the applicant to project a knowledge of <br />this operation to the general public by the use of a sign which does not meet <br />the specific criteria for size as specified in the Zoning Code, but is however, <br />appropriate for the location with the recognition that this zone is one of a <br />mixed use nature. <br />EXHIBIT 3 <br />NARRATIVE STATEMENT <br />
