BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 2-88 <br />Based upon the written request for a variance from the City's zoning code by: <br />Arco Petroleum Products Co. <br />Retail Marketing Design and Engineering <br />515 South Flower St.. <br />Los Angeles, CA ,'071 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.24.020(F), Signs, to allow: a three foot high monument sign not to <br />exceed 22 square feet In area in lieu of 22 square feet of the 30 square <br />feet of permitted wall signs for an Arco AM/PM mini mart to be constructed <br />on the following described property: <br />See Exhibit "A" <br />commonly known as: 901 West. Casino Rd. <br />The Board of Adjustment., following a public hearing on said application held <br />on March 7, 1988, and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />VARIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion No. 1: That. there have been exceptional or extraordinary <br />circumstances or conditions applying to the subject <br />property or as to the intended use thereof that do not <br />apply generally to other properties in the same vicinity <br />or zone. <br />a. Finding: The subject property is part of a 3.8 acre vacant site <br />that is zoned B-1, Nefgh�orhood Business with a contract <br />which allows only multiple family use on the north <br />one-half of the site and B-1. permitted uses on the south <br />half. The applicant is proposing to construct. an Arco <br />AM -PM Mini Market on the southeasterly .75 acre of tle <br />site. The gas station/grocery store is a permitted B-1 <br />use. <br />When the Southwest Everett Comprehensive Plan was <br />completed in 1982, this 3.8 acre site was designated <br />Neighborhood Business. The site was subsequently rezoned <br />from R-3, Multiple Family Residential to Neighborhood <br />Business with Contract in 1984. The conceptual Bite plan <br />approved at that time shows a unified neighborhood <br />business project on the southern portion of the site (see <br />Exhibit. 10). The owner has now subdivided the southern <br />portion of the cite and so there will be commercial <br />activities on two parcels. Therefore, signage will need <br />to be provided for two parcels instead of consolidated <br />signage for one parcel as originally anticipated. <br />The B-1 zone allows wall signs and projecting signs up to <br />a maximum of 30 feet for each separate business <br />establishment.. Pole signs to 30 square feet in area are <br />permitted only for a multi -tenanted building, and so the <br />Arco AM/PM facility does not qualify for a pole sign. <br />
