R. Busby, hereinafter referred to es <br /> "Applicent." <br /> I <br /> WHEREAS, Reverend V. R. Busby and Apostolic Faith Tabernacle are the <br /> lessees of a property located at 2816 Ceder Street in the County of Snohomish, <br /> State ot Washington, de�scribed es tollows: <br /> Lots 27 end 28, Block 657, Swallwell's Second Additfon, Everett, <br /> Recorded in Volume 3, Pege 11 of Plats, Snohomish County. <br /> WHEREAS, the Appllcant has epplled to the City of Everett for a special <br /> property use permit; and . <br /> WHEREAS, the Appllcant has indicated that substantial hardship will result <br /> to the Appltcant if remodeling and constructfon is not allowed to proceed prtor to <br /> the approvel of e special property use permit; and <br /> WHEREAS, the Appl(cant aeknowledges that any expense incurred as e <br /> result of the approval to begin remodeiing and construction is at its own risk and <br /> that the approval to (nitiate said remodeling and construction in no way guarantees . <br /> the final approval of the Applicant's special property use �ermit; and � <br /> WHEREAS, the Clty hes requIred thet the Appltcant comply with several <br /> conditions prior to the tnitiation of remodellng and construction; I, <br /> NOW, THEREFORE, in consideretion of the agreements contafned herein, I <br /> the undersigned Appllcant end lessee of the property described herein agree as <br /> followa: <br /> 1. As e conditlon of allowing remodeling and construction prior to the <br /> Lasuance ot a special property use permit, and without which the City would not <br /> grant said permission, the Appllcant and lessee of the abc+ve-described p�operty <br /> agree to, and hereby do releese, indemnify and save harmless the Ctty, its officers, � <br /> egents and employees, from anA agelnst any and all llability, loss, cost, expense, <br /> actions and elatms for property damage and personal injuries, which is or appeers <br /> to be proximately ceused by the failure to obtain the speclal property use permlt <br /> I <br /> on the above-described property.
