Under Section 35.070 of the Everett Zoning Code, the Planning <br /> Director may, using Review Process II.B, authorize a modification of landscaping requirements. <br /> If no appexl is filed in response to the Planning Director's determination, the decision will be <br /> considered final. If an appeal of the decision is filed, the appeal must be submitted to the City's <br /> Hcaring Examinec .A^, � �,roperty ewner within 300 f?er nf the subject property, you mav aupeal <br /> the Planning Director's decision on this project. <br /> BACKCROUND: The subject property is located in the C-1 General Commercial zone. Section <br /> 35 of the Everett Zoning Code, requires a 5 foot wide landscape strip along the north and south <br /> proPerty lines and a ten foot front yard area landscaped to type III standards for the proposed <br /> pro�ect. A modification to this requirement is pertmtted if the applicant proposes an altemative <br /> method of landscaping that would achieve or exceed the intent and purpose of the landscaping <br /> required by the Zoning Code. <br /> FIND�NC�C: The subject property is 40 feec wide and 100 feet deep. The proposed triplex is 30 <br /> bu Id ng unit�The five feet along the north side and en foot8front yerd area will be fullye <br /> landscaped to type III standards as required. Along the south side the applicant is proposing to <br /> locate a 3 foot wide sidewalk adjacent to the building which leaves only a two foot wide <br /> landscape strip along the south property line. T'he applicant is proposing to install pyramidalis on <br /> three foot centers a minimum of six foot high at the time of planting within the two foot landscape <br /> strip adjacent to the walkway. This will provide for a more dense visual screening between the <br /> adjacent properties than the standard type 111 landscaping would provide. The proposed landscape <br /> modification is allowed subject to the Planning Director's Approval. <br /> � The Planning Di;ectar has made a deterntination to allow for a lendscape <br /> modi cation for the proposed iriplex subject to the following conditions: <br /> �• The aPplicant is required to comply with the approved landscape plan dated August 10, 1994. <br /> Risht to Appeal: The ap�licant or an owner of property located within 300 feet of the subject <br /> propetry may appeal the P anning Director's determination as to whether the proposed <br /> modification should be a permitted. My such appeel must be filed within ten(10)calendar days <br /> of the date spec�fied below. Appeal fortns are available from the Planning Department and must <br /> be submitted along with the required 61ing fee.
