. <br /> n <br /> BOMD OF ADJi1STMENT <br /> FINDINGS� CONCLUSIONS AND ORDER <br /> VARIANCE NO. 4-9�J <br /> Based upon the written request for a variance from the City�s <br /> zoning code by: <br /> Cornelis D. Vanden Ende <br /> 2119 78th P1. W <br /> Edmonds, WA 98020 <br /> hereinafter referred to as "Applicant, " for a variance from <br /> Sec. 34 .060.A. of the zoninq code, to allow construction of a <br /> six-unit apartment that will provide a portion of the required <br /> parking on right of way leased from the City of Everett adja- <br /> ! cent to the lot instead of on the same lot as required by code. <br /> On the property commonly known as: 1617 Chestnut (Lots 9, 10, <br /> and 11, Block 325 of Young's U.P. ) <br /> The Board of Adjustment, following a public hearing on said <br /> application held on June il, 1990, and further having reviewed <br />'� � all testimony, makes the following Findings, Conclusions and ; <br />' Order: <br /> t"� � FINDINGS AND CONCLUSIONS: <br />�- ��' Criterion No. 1• <br />-�'" That the variance is necessary because of exceptional or ex- <br />.�; traordinary circumstances regarding the size, shape, <br />� topography, or location of the subject property; or the loca- <br /> tian of a pre-existing improvement on the subject property that <br /> conformed to the zoninq code in effect when the improvement was <br />,* constructed. <br />�^: <br /> x;` a. Findings: The applicant is proposing to construct a six <br /> unit apartment on a 9,000 square foot site. The rear 35 <br />�' feet of the lot drops into a gully that has had some un- <br />- controlled fill placed in the past. The applicant is <br />�; proposing to finish the fill; however, that area will not <br /> ' be suitable for buildings or parking because of the nature <br /> +'�' of the fill that has been placed in the past. Therefore, <br /> ' the applicant is proposing to lease a portion of the un- <br /> �', used adjacent city right of way to provide enough room for <br /> the requirod nine parking spaces. <br /> j�.. This project underwent Environmental Review and a Deter- <br /> '� mination of Nonsignificance (DNS) was issued July 28 , <br /> r�, 1987. At that time, the Public Works Department approved <br /> the proposed parking layout with the condition that the <br /> "��I City right of way be leased. This portion of Chestnut <br /> ti�;; <br /> will never be widened since it dead ends 125 feet south of <br /> - this property at the north edge of Riverside Park. <br /> '�i' i <br /> z <br /> �� 'Phe applicant has now applied for building permits and <br /> a, durinq routine building permit review it was discovered <br /> .": that a variance had not been obtained to provide a portion <br /> ^n of the parking on city right of way adjacent to the lot <br /> �;, ; <br /> instead of on the lot itself as required by city code. <br /> b. C_onclusions: The unusual circumstances applying to the � <br /> propcity is the gully at the rear that has been partially <br /> 1;, fillec? with unknown material and the fact t�hat there is <br /> unused right of way that the city is willinq to lease to <br /> the applicant for a portion of the parking. <br /> t; � <br /> .� <br /> � <br />
