In determining whether or not to grant thc extension, the examiner shall � . <br /> detertnine whether or not the harm or hardship to the nonconfortn, :g adult use business ' <br /> ounveighs the benefit to be gained from the public from tertnination of the use. Factors to <br /> be considercd by the examiner, the location of the business in rolation to sensitive land <br /> uses such as schools, pazks, churches, residential zone(s), etc., initial capital investment, <br /> investment realization to date, life expectancy of the investment, the existence or <br /> nonexistence of a lease obligation, as well as a contingency clause permitting termination <br /> of the lease, and what a reasonable altemate use of the property exists. The action of the <br /> examiner shall constitute a_Review Process III decision under Ordinance No. 2136-96 (az <br /> it exists or is hereaftec amended). <br /> 4. Within thirty (30)calendaz days of becoming a nonconforming adult use business. <br /> the nonconfortning adult use, shall provide the ciry's planning director with copies of its <br /> curtent leasehold document(s) which sets forth their existing leasehold time period or, in <br /> the case of a nonleasehold interest, the ciry's plaruting dircctor shall be provided other <br /> documents which show record of ownership. Amateur radio towers and antennae for use by a r.aacommercial, licensed amateur <br /> operator shall be allowed if they: <br /> a. Are located and conswcted in a manner that will prevent it from falling onto <br /> adjoining propeRies; <br /> c. Do not interfere with nearby utiliry lines, etc.; <br /> d. Are not located within any required setback area. <br /> 3. An amateur radio tower or antenna may exceed sixty•five feet above the base <br /> elevaiion of the principal building if approved by the planning director using review <br /> process IIB.
