<br /> susta[ned by any person or persons and on account of damage to property, Includtng
<br /> loss of use thereof, ariatng out of or in consequenee of the City grant{ng Owner the
<br /> variance. All references to indemnification include, but are not limited to
<br /> ettorney's fees end court costs. However, thts paragraph does not purport to
<br /> indemnify the City agafnst Itability for damages arising out of bodily inJury to
<br /> peraons or dameges to property caused by or resulttng from the sole negllgence of
