That there have been exceptional or extraordlnary eircumstanoes or <br /> uonditiona epplying to the aub,]eat property or as to the intended uee <br /> thareof that do not apply generally to other properties in the same <br /> vioinity or zone. <br /> Findings On September j0, 1986, Ryssel Homes contraated to oustom <br /> � build this home for Clarance and Patricia Antioquia. The plans were <br /> aubmitted Lo the building department and' r�eated on the basls of its <br /> groas floor area exceeding zoning requiremente��� <br /> , Rysael Homea, Ina. revised the plana by turning one of the garage <br /> bays Snto an open air carport� thereby eliminating it as a finished <br /> floor area in order to meet the groea floor area ratio requirement. <br /> These modificationa to the aontraot were related to the customer, who <br /> strongly obJected. The problem could be resolved with thia variance, <br /> which represente only a modeat deviation from the Zoning Code. This <br /> would allow the home to be built as per the orig#nal cantraet and <br /> avoid the litigatlon and/or appeals whiuh may otherwlae become <br /> neaessary. <br /> The Planning Staff le currently working on an ordinance for review by <br /> the Plflnning Commission that would eliminate the gross floor area <br /> ratio roquirement from tFie Zoning Code. The groea floor area ratio <br /> aonsidere all floora of a building, and the City Ceels a more <br /> reasonaEle way Lo limit lot coverage would be to coneiGer unly the <br /> footprints of all buildings, sinae there is a height limitation that <br /> controls the number ot' Cloors. <br /> Conclusiont The variance as proposed by the Applicant appears to be <br /> a reasonable request. <br />
