WHEREAS, THE EVERETT CITY COUNCIL FINDS: <br /> 1. The record of testimony before the Planning Commission shows the applicant's <br /> representative requested the R-3 zone alternative be considered(with the attendant <br /> Comprehensive Plan map amendment). The argument offered for the rezone to R-3 was that this <br /> would relate the request for the Frauenholtz property to the legally non-conforming apartment <br /> building east of and adjacent to the subject property; and <br /> 2. The stated purpose for the action is to allow use of the subject property to enjoy an <br /> increased residential capacity and that this would require a rezone to R-3; and <br /> 3. The Everett Planning Commission had recommended against the proposed <br /> Comprehensive Plan and rezone change and their desire is to keep this parcel and other parcels in <br /> the area single family zoning; and <br /> 4. Nearby residents have testified they appreciate the single family character of the area and <br /> would not want to see it begin to convert over to higher density residential use; and <br /> 5. The building height restriction of 28 feet for the development of multiple family <br /> dwellings on the subject property will result in greater compatibility with the surrounding single <br /> family neighborhood than the height that otherwise would be permitted in the R-3 zone; and <br /> 6. After testimony at the March 23, 2005, public hearing the Everett City Council has <br /> decided to change the Comprehensive Plan and rezone the area subject to height conditions; and <br /> 7. The desire of the City Council is to improve the quality of the housing units in the area; <br /> and <br /> 8. The location of these parcels on Pecks Drive makes logical sense to allow this rezone, <br /> and it is not the intent for City Council by this action to set a precedent for other rezones to <br /> multiple family in the area; and <br /> 9. Based on the statement of the applicant the desire to build 3 to 4 units on the parcel they <br /> own which is being rezoned; and <br /> NOW, THEREFORE, THE EVERETT CITY COUNCIL RESOLVES THAT: <br /> 1. The comprehensive plan land use designation for the properties designated on the <br /> attached Exhibit A shall be changed from 1.2 "Single Family Detached, 5 to 10 <br /> Dwellings per Gross Acre"to "Multiple Family, 20 to 29 Dwellings per Gross Acre." <br /> 2. The subject properties shall be rezoned from R-2 (Single Family Detached Medium <br /> Density) to R-3 (Multiple Family Medium Density), with a building height restriction of <br /> 28 feet. <br /> - 2 - <br />
