I <br /> PLANNING DIRECTOR DETERMINATION <br /> Expansion of Non-conforming Building Setback <br /> Review Process II#00-017 <br /> INTRODUCTION: The City of Everett Planning Department has received an application from K(p <br /> Grooms, 1409 Colby Avenue, Everett, WA 98201, to expand an exieting 22'6" X 18'6" accessory <br /> building, to a new dimension of 25' X 22'. The expansion would consist of replacing the existing <br /> structure. The expansion would a�so include the increase in height of the accessory building fiom <br /> 11'3" to 14'. The existing structure has zero setback from the southem (side) property line. The <br /> expansion would continue to the west along this zero foot setback line. Section 38.040 allows for the <br /> Planning Director to allow for the expansion of a structure which does not meet required setbacks, <br /> provided that the expansion does not make the setback more nonconforming; that the expansion <br /> complies with all other requirements of the zoning ordinance; and that the nonconformity has been <br /> certified by the Planning Department. <br /> BACKGROUND: The proPerty is located in the R-2, Single Family Detached Medium Density Zone. <br /> The required setback is 5 from a side property line for single family residences and any accessory <br /> structures. There is an existing accessory structure on the site. The accessory building is 22'6" wide <br /> - by 18'6" deep and 356 sq.ft. in area. It is located on the south eastem property line. According to <br /> Snohomish County Assessor's Records this structure was built prior to December 1, 1956. This <br /> structure is considered legal non-confortning or "grandfathered" as it predates the City's zoning code <br /> requirement for structures to have a minimum setback of five feet (5') from the side property line. The <br /> applicant proposes to make an addition of 3.5', along the nonconfiorming setback line, to the existing <br /> structure, and raise the roof to a new height of 14'. The new structure will have zero setback from the <br /> southem (side) property line, consistent with the existing structure. <br /> FINDINGS: The existing accessory building has been certified as legal nonconforming related to <br /> setbacks (NCB #00-014). The applicant proposes to make an addition of 3.5' along the southem side <br /> of the existing structure and raise the height to 14'. The new structure wiil have zero setback from the <br /> side property line and will not create any further non-conformities than presently exists. <br /> DECISION: The Planning Director has determined to allow for the proposed addition to the existing <br /> accessory building with zero setback from the southem (side) property line with the following <br /> conditions: <br /> • A Building Permit is required for this structure. Compliance with the commercial fire, life and <br /> structural standards of the building code is required. <br /> • Any grading/fill on this site shall be done so as to not impact the surrounding properties. <br /> • City streets and alleys are to be kept clear of dirt and debris at all times during construction. <br /> Dust suppression and street cleaning must occur as directed by the Public Worics Inspector. <br /> • Rooftop runoff from this structure shall be tightlined to the sewer. <br />
